Dusware Inc. Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Dodging Danger & dodgingdanger.com (the "Service"), including all games, software, websites, content, and services provided by Dusware Inc. ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 13 years old to use Service. If you are under 18, you represent that you have the consent of a parent or legal guardian to agree to these Terms.

3. Code of Conduct

3.1 Prohibited Behavior

While we give players plenty of room to have fun, certain behaviors cross the line and harm our community. You must not engage in actions that disrupt, offend, or endanger others. Prohibited behaviors include, but are not limited to:

• Sexually Explicit Content: Posting, sharing, or creating content (text, images, audio, or UGC) that depicts nudity, sexual acts, or suggestive themes intended for sexual gratification. This includes flirtatious or romantic content meant to pursue real-world relationships. Exceptions are not permitted unless explicitly approved by Dodging Danger staff.
• Harassment and Abuse: Targeting others with bullying, hate speech, discriminatory remarks (based on race, gender, sexuality, religion, or other traits), or threats that make players feel unsafe or unwelcome.
• Cheating and Exploits: Using hacks, bots, or unauthorized methods to manipulate gameplay, gain unfair advantages, or disrupt the game's integrity.
• Illegal Activities: Sharing or promoting content that violates local, national, or international laws, including fraud, piracy, or content that exploits minors (which we will report to the right authorities).
• Impersonation: Pretending to be another player, Dodging Danger or Dusware staff, or any entity to deceive or mislead others.

Enforcement: We take a fair but firm approach to keep Dodging Danger enjoyable. Minor slip-ups may result in a friendly warning or temporary restrictions (e.g., chat muting). Repeated or severe violations—especially involving sexual content, harassment, or illegal acts—may lead to:

• Removal of offending content.
• Temporary suspension of features like chat, UGC creation, or account access.
• Permanent account suspension or bans for egregious or repeated offenses.

Our moderation team uses a mix of automated tools and human review to evaluate violations, considering context and severity. If you believe we got it wrong, you can appeal within 30 days by emailing support@dusware.com. Report violations using in-game tools or contact our support team.

4. Intellectual Property Ownership

4.1 Ownership

All content, including but not limited to game code, artwork, music, sound effects, characters, storylines, text, graphics, logos, designs, user interfaces, and other materials available on or through the Service ("Content"), is owned by Dusware Inc. or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws.

4.2 License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial purposes only, subject to compliance with these Terms. This license does not include any right to copy, distribute, modify, or create derivative works of the Content unless expressly authorized in writing by us.

4.3 Prohibited Actions: You may not, under any circumstances

• Copy, reproduce, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of any Content or the Service.
• Distribute, publish, sell, lease, lend, sublicense, or otherwise make available any part of the Service or Content to third parties, including via file-sharing platforms, torrents, or unauthorized servers.
• Circumvent, disable, or bypass any technological protection measures (e.g., Digital Rights Management) implemented in the Service.
• Use any automated tools, scripts, or software to extract, scrape, or harvest Content from the Service.
• Use the Service or Content for any commercial purpose, including but not limited to creating competing products or services.

5. Restrictions on Distribution

5.1 No Unauthorized Distribution

You are strictly prohibited from distributing the Service, including the game or any Content, in any form (e.g., physical media, digital downloads, or streaming) without our express written permission. This includes, but is not limited to:

• Sharing game files or Content via peer-to-peer networks, torrents, or unauthorized platforms.
• Selling, renting, or transferring access to the Service or Content to third parties.

5.2 Platform Restriction

The Service may only be accessed through platforms explicitly authorized by us (e.g., dodgingdanger.com, Steam, or other approved distributors). Any attempt to access or distribute the Service through unauthorized platforms will result in immediate termination of your account and legal action.

6. Prohibited File Uploads

6.1 File Type Restriction

The Service does not permit the upload of certain file types, including but not limited to .pdf, .doc, .docx, .zip, or any executable files, to prevent security risks and unauthorized content distribution. Any attempt to upload such files will result in immediate rejection and may lead to account suspension or termination.

6.2 Content Validation

All uploaded files are subject to automated and manual review. We reserve the right to reject or remove any uploaded content that violates these Terms or poses a security risk.
